Terms & Conditions
The terms governing enquiries, quotations, bookings and travel services provided by Banyan Holidays.
Effective date: 23 July 2026
These Terms & Conditions apply to quotations, reservations and travel-related services arranged by Banyan Holidays (“we”, “us” or “our”). By confirming a booking, making a payment, or authorising us to proceed, the lead traveller and all persons included in the booking agree to these terms and to any additional written conditions stated in the quotation, itinerary, invoice or booking confirmation.
1. Our role
Banyan Holidays arranges travel services that may be supplied by independent third parties, including airlines, hotels, cruise lines, transport operators, destination-management companies, tour guides, insurers and visa-service providers. Each supplier’s own terms, cancellation rules and operational conditions also apply.
2. Quotations and availability
Unless expressly stated otherwise, quotations are subject to availability and may change before confirmation due to airfare, exchange-rate, tax, surcharge, hotel, transport or supplier changes. A quotation does not reserve any service until the required payment is received and written confirmation is issued.
3. Booking responsibility
The lead traveller must provide complete and accurate names, dates of birth, passport details, contact information and other required information for every traveller. Names must match travel documents exactly. Costs arising from incorrect, incomplete or late information are the traveller’s responsibility.
4. Payments
Deposits, instalments and final-payment deadlines will be stated in the quotation or invoice. A booking may be cancelled if payment is not received by the deadline. Bank charges, card charges, currency-conversion costs and supplier-imposed fees may apply.
5. Prices
Confirmed prices are based on the services, passenger count, rooming, travel dates and assumptions stated in the booking. Prices may be adjusted where permitted by applicable law if taxes, government fees, fuel surcharges, exchange rates or supplier charges change, or if the traveller requests a modification.
6. Passports, visas and entry requirements
Travellers are responsible for holding valid passports, visas, permits, health documents, insurance and all documents required by transit and destination authorities. Visa approval, immigration admission and processing time are determined solely by the relevant authorities and cannot be guaranteed by Banyan Holidays.
7. Health, safety and insurance
Travellers should review current health, safety and entry advice and disclose any condition, mobility need, pregnancy or dietary requirement that may affect the trip. Comprehensive travel insurance covering cancellation, medical care, personal belongings, delays and emergency evacuation is strongly recommended.
8. Changes requested by the traveller
Any request to change names, dates, routes, hotels, room types or other services is subject to availability and supplier approval. Fare differences, amendment charges, service fees and other costs may apply.
9. Changes by suppliers or unforeseen events
Schedules, routes, hotels, transport and activities may change because of weather, operational requirements, government action, strikes, natural events, public-health events, security concerns, supplier failure or circumstances beyond reasonable control. We will make reasonable efforts to offer a suitable alternative, but additional costs and supplier rules may apply.
10. Traveller conduct
Travellers must comply with laws, safety instructions, accommodation rules and reasonable directions from suppliers and group leaders. A traveller may be removed from a service where conduct creates risk, disruption, harassment, damage or unlawful activity. Resulting expenses are the traveller’s responsibility.
11. Complaints
Problems should be reported immediately to the relevant supplier and to Banyan Holidays so that a reasonable opportunity is available to assist. Supporting documents should be retained. Any unresolved written complaint should be sent promptly after the service ends.
12. Liability
To the maximum extent permitted by law, Banyan Holidays is not responsible for acts, omissions, insolvency or failures of independent suppliers, or for loss caused by events outside reasonable control. Nothing in these terms excludes liability that cannot legally be excluded. Any remedy may be subject to applicable law and the terms of the supplier responsible for the service.
13. Intellectual property
Website text, branding, itineraries, graphics and original materials may not be copied, republished or commercially used without written permission, except for personal use connected with a genuine enquiry or booking.
14. Privacy
Personal information is handled according to our Privacy Policy.
15. Governing terms
If a quotation, itinerary, invoice or booking confirmation contains specific conditions that differ from these general terms, the specific written booking conditions will prevail for that booking. Mandatory consumer rights under applicable law remain unaffected.
